1. Acceptance of Terms

By downloading, installing, or using the Pinch mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a binding agreement between you and Pinch ("we," "our," or "us"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Pinch is a personal finance management application that provides tools for expense tracking, spending analysis, financial goal setting, and AI-powered financial guidance. The App is intended for personal, non-commercial use only.

Important: Pinch is not a licensed financial advisor, bank, or financial institution. The information and insights provided by the App are for informational purposes only and do not constitute financial, investment, legal, or tax advice. You should consult a qualified professional before making financial decisions.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you must have permission from a parent or legal guardian.

4. Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

Pinch offers a free tier and a paid Pro subscription. By subscribing to Pinch Pro, you agree to the following:

• Billing: Subscriptions are billed in advance on a monthly or annual basis through Apple's App Store. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then.
• Refunds: All purchases are processed by Apple and are subject to Apple's refund policy. We do not issue refunds directly.
• Free trial: If offered, a free trial automatically converts to a paid subscription unless cancelled before the trial period ends.
• Price changes: We may change subscription prices with advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.

6. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App for any fraudulent or unlawful purpose
• Transmit any malicious code, viruses, or harmful data

7. AI-Powered Features

The App includes AI-powered tools that provide insights, suggestions, and responses based on the data you provide. You acknowledge that:

• AI-generated content may not always be accurate, complete, or up to date
• Suggestions and predictions are informational only and not guaranteed
• You are solely responsible for any financial decisions you make based on information provided by the App
• We are not liable for any losses arising from reliance on AI-generated content

8. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Pinch and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

9. User Content

You retain ownership of any financial data, notes, or other content you submit to the App ("User Content"). By submitting User Content, you grant us a limited license to use, store, and process it solely for the purpose of providing and improving the App's services.

You represent that your User Content does not violate any third-party rights or applicable laws.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Pinch shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD if you have not made any payments.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason — including if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time from the App's profile settings. Sections of these Terms that by their nature should survive termination will do so.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Pinch operates, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

14. Apple App Store Additional Terms

If you downloaded the App from Apple's App Store, you acknowledge that:

• These Terms are between you and Pinch only, not with Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• In the event of any conflict between these Terms and Apple's App Store terms, Apple's terms shall govern
